1.6 The Constitution

The constitution refers to a formal document that contains the rules, functions, and roles of the constitution. These outlined details are meant to govern and guide the government organizations and state bodies on how to relate with the public. The constitution is the first document that is quoted whenever a law has to be referenced.

Supremacy of the constitution

This refers to the overriding importance of the constitution above any other law. It is said to be supreme because of;

  • All other laws derive their force and validity with or from the constitution
  • Any law that is inconsistent with the constitution shall be rendered void to the extent of its inconsistency.
  • It establishes the three organs of the state.
  • It provides for the protection of the fundamental rights and freedom of an individual.
  • It provides for the appointment of the president and its prerogatives.
  • Its operation required special majority of votes of parliamentarians; and sometimes it may be put to a referendum.
