1.4 Overview and the Role of Judicial Review

1.4 OVERVIEW AND THE ROLE OF JUDICIAL REVIEW

Judicial review is a fundamental concept in constitutional law that allows the judiciary to review the legality and constitutionality of laws, regulations, executive actions, and decisions made by government entities. It ensures that the actions of the government adhere to the constitution and protects individual rights and freedoms.

Role of judicial review

  1. Constitutionality: Judicial review ensures that laws and government actions are consistent with the provisions of the constitution. Courts assess whether legislative acts and executive decisions comply with the constitutional framework and do not violate constitutional rights and principles.
  2. Rule of Law: Judicial review upholds the principle of the rule of law, which holds that everyone, including the government, is subject to and must abide by the law.
  3. Protection of Individual Rights: Judicial review safeguards individual rights and liberties. It allows individuals and groups to challenge laws and actions that infringe upon their constitutional rights, such as freedom of speech, religion, or due process. Courts play a crucial role in safeguarding these rights and ensuring their protection.
  4. Checks and Balances: Judicial review serves as a mechanism to check and balance the powers of the executive and legislative branches of government. It allows the judiciary to review and potentially invalidate laws and actions that exceed the authority granted to these branches or violate constitutional principles.
  5. Legal Consistency and Interpretation: Judicial review helps ensure legal consistency and uniformity in the interpretation and application of laws. Courts provide authoritative interpretations of legal provisions, establish precedents, and resolve conflicts between different laws or legal interpretations.
  6. Legal and Constitutional Remedies: Judicial review provides individuals and groups with legal remedies and recourse. Courts can issue remedies, such as injunctions or declaratory judgments, to address legal violations or unconstitutional actions.
  7. Public Confidence and Trust: Judicial review enhances public confidence in the legal system and the government. By providing an avenue for legal recourse and ensuring government actions are subject to legal scrutiny, it contributes to a fair and just society.
