1. Introduction

Welcome to RCM Online College, operated by RCM Online College Limited. These Terms of Service govern your access to and use of our website, mobile applications, learning management system, online courses, live classes, downloadable materials, community features, certificates, and related services.

By creating an account, purchasing a course, accessing our website, using our mobile applications, joining a class, downloading learning materials, participating in discussions, or using any part of our platform, you agree to be bound by these Terms of Service.

If you do not agree with these Terms, you should not use our website, mobile applications, courses, learning materials, or related services.

2. Definitions

In these Terms:

“RCM”, “we”, “us”, or “our” means RCM Online College Limited.
“Platform” means the RCM Online College website, mobile applications, learning management system, student portal, community features, and related services.
“User”, “student”, “you”, or “your” means any person who accesses or uses the Platform.
“Course” means any online class, program, unit, module, live lesson, recorded lesson, downloadable resource, assessment, or learning material offered through the Platform.
“App” means the RCM Online College Android or iOS mobile application.
“Content” means videos, notes, PDFs, assignments, quizzes, certificates, images, text, audio, live sessions, discussions, and any other material available on the Platform.

3. Eligibility

The RCM Online College Platform is intended for users who are at least 18 years old. By using the Platform, you confirm that you are 18 years or older and have the legal capacity to enter into these Terms.

If we discover that an account has been created by a person who does not meet this age requirement, we may suspend or delete the account in accordance with applicable law and our internal policies.

4. Account Registration and Security

To access courses, live classes, certificates, community features, downloads, and other student services, you may be required to create an account.

You agree to:

Provide accurate, current, and complete registration information.
Keep your login details confidential.
Use your own account and not share it with another person.
Notify us immediately if you suspect unauthorized access to your account.
Update your personal details where necessary.

You are responsible for all activities that occur under your account. RCM Online College will not be liable for loss or damage caused by your failure to protect your login details.

5. Course Enrollment and Access Period

RCM Online College offers time-limited access to courses. Unless otherwise stated on the course page, student access to a purchased course is granted for a period of approximately three (3) months from the date of enrollment, purchase, or activation.

Course access may include recorded lessons, live classes, notes, discussion forums, assignments, quizzes, downloadable materials, and certificates, depending on the specific course purchased.

RCM Online College reserves the right to update course structure, tutors, schedules, content, assessments, or delivery methods where necessary to improve learning outcomes or maintain academic quality.

6. Course Purchases, Fees, and Payments

Course fees are displayed before purchase. Fees may vary depending on the course, intake, offer, promotion, platform, or payment channel.

RCM Online College may accept payments through:

M-Pesa
Bank transfer
WooCommerce checkout
Google Play Billing
Apple In-App Purchases
Any other approved payment channel introduced by RCM Online College

Where payments are made through Google Play or Apple App Store, the transaction may also be governed by Google’s or Apple’s applicable payment terms, billing policies, refund procedures, and account rules.

You agree to pay all applicable fees before accessing paid courses or services. RCM Online College may restrict access where payment is pending, reversed, incomplete, disputed, or suspected to be fraudulent.

7. Refund and Rescheduling Policy

Once a student has enrolled in a course, purchased a course, or gained access to course materials, fees are generally non-refundable.

RCM Online College may allow a student to reschedule to a future intake or class only if the student notifies us within seven (7) days of enrollment or purchase. Rescheduling is subject to course availability, intake availability, administrative approval, and any applicable academic requirements.

No refund or rescheduling is guaranteed where:

The student has substantially accessed course content.
The student has downloaded learning materials.
The student has attended live classes.
The student has completed assessments.
The access period has significantly elapsed.
The request is made after the 7-day notification period.
The account has been suspended for breach of these Terms.

For purchases made through Apple App Store or Google Play, refund requests may be subject to Apple’s or Google’s refund rules and processes.

8. Live Classes and Zoom Sessions

RCM Online College may provide live classes, webinars, tutor sessions, revision sessions, or consultations through Zoom or other approved live learning platforms.

Students are responsible for ensuring they have a stable internet connection, compatible device, updated software, and a suitable learning environment.

You agree not to:

Share live class links with unauthorized persons.
Record live sessions without permission.
Disrupt classes or interfere with tutors and other students.
Use offensive, abusive, discriminatory, or inappropriate language.
Impersonate another student or staff member.

RCM Online College may remove a student from a live class or suspend access where the student violates class rules or disrupts the learning environment.

9. Downloads and Offline Access

Some courses may allow students to download notes, PDFs, videos, assignments, or other learning materials for offline study.

Downloaded materials are provided strictly for your personal educational use. You may not copy, resell, upload, redistribute, publish, share, reproduce, modify, or commercially exploit any downloaded materials without written permission from RCM Online College.

Offline access may be limited by course settings, device settings, app permissions, security controls, access period, or licensing restrictions.

10. Student Community, Groups, Forums, and Messaging

RCM Online College may provide community features, including student groups, discussion forums, profile photos, messaging, assignments, file uploads, comments, and peer interaction features.

You agree to use these features respectfully and for legitimate educational purposes only.

You must not:

Post abusive, hateful, discriminatory, obscene, threatening, or defamatory content.
Harass, bully, intimidate, or abuse other users.
Upload malware, harmful files, spam, or unauthorized promotional content.
Share exam answers, plagiarized work, or unauthorized academic material.
Misrepresent yourself or impersonate another person.
Use the community for fraud, solicitation, or unlawful activities.

RCM Online College may moderate, remove, restrict, or delete content that violates these Terms or affects the safety, quality, or integrity of the learning environment.

11. Assignments, Assessments, and Academic Integrity

Students are expected to complete assignments, quizzes, coursework, and assessments honestly and independently unless collaboration is expressly permitted.

The following are prohibited:

Plagiarism.
Cheating.
Submitting another person’s work as your own.
Sharing assessment answers.
Using unauthorized materials during assessments.
Manipulating course completion records.
Fraudulently obtaining certificates.

Violation of academic integrity rules may lead to suspension, certificate cancellation, account restriction, or other appropriate action.

12. Certificates and Verification

RCM Online College may issue digital certificates to students who successfully complete eligible courses and meet the applicable completion requirements.

Certificates may be generated automatically upon course completion, subject to system rules, course requirements, tutor approval, payment status, and verification checks.

RCM Online College provides a certificate verification system that may allow third parties to confirm the authenticity of issued certificates.

RCM Online College reserves the right to withhold, correct, suspend, revoke, or invalidate a certificate where:

The certificate was issued in error.
The student provided false information.
The student violated academic integrity rules.
Payment was reversed, disputed, or not completed.
The certificate was fraudulently obtained or altered.

13. Intellectual Property Rights

All content on the RCM Online College Platform, including course videos, notes, PDFs, slides, graphics, logos, text, assessments, certificates, software, designs, trademarks, and learning materials, belongs to RCM Online College Limited or its licensors.

You are granted a limited, personal, non-transferable, non-exclusive license to access and use the content for your own learning purposes only.

You must not:

Copy, reproduce, or redistribute course content.
Sell, rent, sublicense, or commercially exploit learning materials.
Record, download, or share videos unless expressly permitted.
Remove copyright notices or branding.
Upload RCM materials to public websites, social media, file-sharing platforms, or messaging groups.
Use RCM content to create competing courses or services.

Any unauthorized use of RCM Online College content may result in account suspension, legal action, or other remedies available under applicable law.

14. User-Generated Content

You may be allowed to upload or submit content, including assignments, profile photos, comments, discussion posts, files, messages, and feedback.

You retain ownership of your own content, but by submitting content to the Platform, you grant RCM Online College a limited permission to host, store, process, display, review, moderate, and use that content as necessary to provide educational services.

You confirm that any content you upload does not violate the rights of another person, including copyright, privacy, confidentiality, or intellectual property rights.

15. Mobile Application Terms

The RCM Online College mobile applications are provided to help students access courses, learning materials, live sessions, notifications, community features, downloads, certificates, and related services.

You agree not to:

Reverse engineer, decompile, modify, or tamper with the App.
Attempt to bypass security controls or access restrictions.
Use the App for unlawful, fraudulent, or abusive purposes.
Interfere with the operation of the App or related servers.
Use automated scripts, bots, scraping tools, or unauthorized integrations.

App functionality may depend on your device, operating system, internet connection, app version, permissions, and third-party services.

16. Apple App Store and Google Play Terms

Where you download or purchase services through the Apple App Store or Google Play Store, you acknowledge that Apple or Google may have separate terms, billing policies, refund rules, and account requirements that apply to your use of their platforms.

RCM Online College is responsible for providing its educational services, while Apple and Google are not responsible for course delivery, academic support, certificates, or student services provided by RCM Online College.

For purchases made through Apple or Google, billing, payment confirmation, cancellation, and refund processes may be handled through your Apple ID or Google Play account.

17. Privacy and Data Protection

Your privacy is important to us. RCM Online College collects and processes personal information to provide educational services, manage student accounts, process payments, issue certificates, provide support, deliver notifications, improve the Platform, and comply with legal obligations.

Information we may process includes your name, email address, phone number, account details, course progress, payment status, device information, app usage data, certificate details, assignments, communications, and learning activity.

RCM Online College may use third-party service providers including hosting providers, payment processors, analytics tools, communication tools, and live class platforms such as AWS, Google Analytics, WooCommerce payment channels, Apple, Google, and Zoom.

Use of the Platform is also governed by our Privacy Policy, which should be read together with these Terms.

18. Notifications and Communications

By creating an account, you agree that RCM Online College may contact you through email, phone, platform notifications, push notifications, or other approved communication channels for purposes related to your account, courses, payments, classes, certificates, security, service updates, and learning support.

RCM Online College may introduce SMS notifications in the future for student support, course reminders, security alerts, payment updates, or administrative communication.

19. Account Deletion

Users may delete their account through available self-service account settings within the Platform or mobile application.

When an account is deleted, access to courses, certificates, downloads, community features, messages, learning history, and related services may be permanently removed or restricted.

RCM Online College may retain certain records where required for legal, regulatory, accounting, fraud prevention, academic integrity, certificate verification, dispute resolution, or legitimate business purposes.

20. Service Availability

RCM Online College aims to provide reliable access to the Platform, but we do not guarantee that the website, app, courses, live classes, downloads, certificates, or community features will always be available without interruption.

Service interruptions may occur due to maintenance, updates, hosting issues, internet outages, third-party service failures, security incidents, payment gateway issues, or circumstances beyond our reasonable control.

21. Third-Party Services

The Platform may integrate with or rely on third-party services, including but not limited to AWS hosting, Zoom, Google Analytics, Apple App Store, Google Play Store, WooCommerce, payment processors, and communication tools.

Your use of third-party services may be subject to their own terms and privacy policies. RCM Online College is not responsible for third-party service outages, policy changes, pricing changes, data practices, or technical failures outside our control.

22. Suspension and Termination

RCM Online College may suspend, restrict, or terminate your account or access to services where we reasonably believe that you have:

Violated these Terms.
Shared your account with another person.
Distributed course materials without permission.
Engaged in fraud, abuse, harassment, or misconduct.
Failed to complete payment.
Misused certificates or verification systems.
Attempted to compromise the Platform’s security.
Violated academic integrity rules.

Suspension or termination may result in loss of access to courses, downloads, community features, live classes, certificates, and other services.

23. Disclaimer of Educational Outcomes

RCM Online College provides educational content, tutor support, learning tools, and course resources. However, we do not guarantee specific examination results, employment outcomes, promotions, business success, licensing approvals, or professional advancement.

Your success depends on your attendance, participation, study discipline, completion of assignments, personal effort, prior knowledge, internet access, device access, and other factors outside our control.

24. Limitation of Liability

To the maximum extent permitted by law, RCM Online College Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

This includes, but is not limited to, loss of data, loss of income, loss of opportunity, business interruption, device failure, internet issues, third-party service failures, missed classes, or inability to access course materials due to circumstances beyond our reasonable control.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

25. Indemnity

You agree to indemnify and hold harmless RCM Online College Limited, its directors, employees, tutors, agents, partners, and service providers from any claims, losses, damages, liabilities, costs, or expenses arising from your breach of these Terms, misuse of the Platform, violation of another person’s rights, or unlawful conduct.

26. Changes to These Terms

RCM Online College may update these Terms from time to time to reflect changes in our services, laws, app store requirements, payment processes, academic policies, or operational needs.

Updated Terms will be posted on our website or made available through the Platform. Continued use of the Platform after changes are posted means you accept the updated Terms.

27. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

Any disputes arising from these Terms or your use of the Platform shall first be handled through good-faith discussions with RCM Online College. Where no resolution is reached, the dispute may be referred to the appropriate courts or dispute resolution mechanisms in Kenya.
