3.6 Enviromental and Land Court

The Environmental and Land Court is a specialized court that exists in some countries to handle cases related to environmental conservation, land disputes, and issues concerning natural resources.

Jurisdiction of the court

The court shall have original and appellate jurisdiction to hear and determine all disputes:

  1. Relating to environment, planning and protection of climate issues
  2. Relating to compulsory acquisition of land
  3. Relating to land administration and management
  4. Relating to public, private and community land and contracts
  5. Any other disputes relating to environment and land.

Powers of the court

The court shall have power to make any of the allowing order.

  1. Interim or permanent orders including injunctions
  2. Pre negative orders
  3. Award of damages
  4. Compensation
  5. Restitution
  6. Declaration
